Liability Limitation

The dispensation of damage claims, due to the lack of guaranteed qualities, and all kinds of damage claims according to the service liability law ( default in contract operations, positive contract damage, unlicenced operation )are not valid for us.

However, the actions done on purpose regarding the relationships with buyer, or because of a gross fault/negligence of our legal representative, or the gross fault/negligence of our management and assistant staff, are excluded. In case of delay or impossibility, we accept the responsibility for a fault or negligence affecting those who are not tradesmen.

However, this amount is limited to extra expenses or reserves for short coverings. In case the contract liabilities are destroyed on behalf of our legal representatives and management staff, we take responsibility for simple mistakes/negligence. However, these are limited to already known or predicted damages. In case SPENAK LTD goes under liability as the solidary debtor, it is only liable of second rank from the last range.

In case of data lost, SPENAK LTD takes responsibility only if this data is taken under security in a way that the machine recognizes them once a day. The liability restrictions mentioned above are also valid for the advantage of our legal representatives, management and customer service staff.
