Liability Limitation
The dispensation of the damage demands for the lack of guaranteed qualities, and the damage demands of that kind ( default in contract operations, positive harmed contract, unlicenced operation )are not valid for us. However, the actions done on purpose regarding the relationships with buyer, or because of a gross mistake/negligence of our legal representative, or the gross negligence/mistake of our management and helping staff, are excluded.In case of delay or impossibility, we accept the responsibility for a mistake or negligence done to those who are not a tradesmen. However, this amount is limited to extra expenses or reserves for short coverings.In case that the contract liabilities are destroyed on behalf of our legal representatives and management staff, we do not take responsibility for simple mistake/negligence.
However, these are limited to the already known or predicted harms.In case SPENAK LTD. goes under liability as solidary debtor, it is only liable of second rank from the last range.
In case of data lost, SPENAK LTD. takes responsibility only if this data is taken under security in a way that the machine recognizes them once a day. The liability restrictions mentioned above, are also valid for the advantage of our legal representatives, management staff and helping staff.
